1. Acceptance of these terms

These Terms of Use (“Terms”) form a binding agreement between you and 9XO (“9XO”, “we”, “us”, or “our”) when you access this website, create an account, upload personalization content, or place an order. By using the website, you confirm that you have read and agree to these Terms and our Privacy Policy.

If you do not agree, do not use the website or place an order. Additional product notes, customization instructions, offer conditions, payment-gateway terms, and Help Center policies may also apply. If they conflict with these Terms, these Terms control unless we expressly state otherwise.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract under Indian law to place an order. If you are under 18, a parent or lawful guardian must review these Terms and place the order for you. You may use the store only for lawful personal or business gifting purposes.

3. Account responsibilities

You must provide current, complete, and accurate account, billing, delivery, and contact information. You are responsible for maintaining the confidentiality of your password and for activity under your account. Notify us through the Help Center promptly if you suspect unauthorised access.

We may suspend or close an account that is fraudulent, abusive, unlawful, compromises security, or materially breaches these Terms. You remain responsible for valid orders placed before suspension or closure.

4. Personalized products and uploaded content

Your review responsibility

You are responsible for checking names, dates, spellings, addresses, image selection, crop, orientation, and other personalization details before submitting an order. Screen previews are illustrative: colours, brightness, positioning, and proportions may vary slightly because screens, materials, print methods, and product dimensions differ.

Your rights in uploaded content

You retain ownership of photos, images, messages, and other content you provide. By submitting content, you grant 9XO and its production partners a limited, non-exclusive, royalty-free licence to host, copy, crop, resize, adjust, print, manufacture, quality-check, package, and otherwise use that content only as reasonably necessary to fulfil the order, provide support, and comply with law.

You confirm that you own the content or have all permissions needed to use it and authorise us to reproduce it. If the content depicts another person, you confirm that you have any consent required to provide and print the image.

Prohibited content

You must not upload content that:

• infringes copyright, trademark, privacy, publicity, personality, or other rights;
• is unlawful, threatening, hateful, obscene, sexually exploitative, defamatory, harassing, or discriminatory;
• promotes violence, terrorism, criminal activity, self-harm, or abuse;
• contains malware, deceptive instructions, or material intended to compromise our systems; or
• includes sensitive identity, financial, or confidential information not needed for the product.

We may reject, pause, or cancel an order containing prohibited or technically unsuitable content. Where reasonably possible, we will explain the issue. A refund, if any, may exclude costs already incurred where the cancellation resulted from your breach of these Terms, subject to applicable consumer law.

5. Orders, acceptance, and pricing

Products, availability, promotions, and prices may change without notice before you order. Prices are shown in Indian Rupees (INR). Taxes, shipping charges, and discounts are displayed at checkout where applicable.

Your checkout submission is an offer to buy. An automated acknowledgement confirms receipt, not final acceptance. We accept the order when we begin production or otherwise confirm acceptance. Because personalized items may enter production quickly, changes or cancellations are not guaranteed after submission.

We may correct typographical, pricing, availability, tax, discount, or technical errors and may refuse or cancel an affected order. If we cancel after receiving payment, we will initiate a refund to the original payment method. We may also limit quantities, request verification, or cancel orders reasonably suspected of fraud, resale abuse, or system misuse.

6. Payments

You must pay the amount shown at checkout using an available payment method. Payment options may include UPI, Visa, Mastercard, PayPal, and other methods offered by our third-party gateways. Availability may vary by transaction.

Payment processing is subject to the gateway, bank, card-network, or wallet provider’s terms. 9XO does not store full card numbers, CVV codes, UPI PINs, or banking passwords. An order may be held or cancelled if payment is declined, reversed, disputed, incomplete, or flagged for verification.

7. Shipping and delivery

We deliver to serviceable addresses across India. Production and delivery estimates shown on a product page, at checkout, or in the Help Center are estimates rather than guaranteed dates unless we expressly agree otherwise in writing. Personalized products require production time before dispatch.

You are responsible for providing a complete address, correct PIN code, reachable mobile number, and any delivery instructions. Delays may result from an incorrect address, failed delivery attempts, customization clarification, courier disruption, severe weather, public holidays, remote-area service, force-majeure events, or other circumstances outside reasonable control.

Risk of loss passes to you upon delivery to the address provided. If tracking shows delivery but you cannot locate the parcel, or if a parcel is materially delayed, contact the Help Center promptly so we can assist with the courier investigation.

8. Returns, replacements, and refunds

We accept a claim where an item arrives damaged or has a manufacturing defect, provided you contact us within 48 hours of delivery and provide the order number, clear photos or video of the item, packaging, and shipping label. This matches our Return & Exchange help article.

After review, we may arrange a replacement, reprint, repair, store credit, or refund as appropriate to the issue and applicable law. We may ask you to retain or return the product for inspection. Normal wear, misuse, accidental damage after delivery, and differences caused by low-resolution or incorrectly supplied customer content are not manufacturing defects.

Approved refunds are initiated to the original payment method. Bank or gateway processing times are outside our control. Nothing in this section excludes remedies that cannot lawfully be excluded under applicable Indian consumer law.

9. Intellectual property

The website and its software, layout, product photography, graphics, logos, copy, catalog structure, design elements, and other 9XO-provided content are owned by or licensed to 9XO and protected by applicable intellectual-property laws. You may browse and purchase through the site for personal, non-commercial use, but may not copy, scrape, republish, sell, reverse engineer, frame, or commercially exploit site content without written permission.

Your uploaded content remains yours, subject to the limited production licence in Section 4. We do not acquire ownership merely because you upload it.

10. Acceptable use

You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, automate excessive requests, scrape personal or commercial data, impersonate another person, manipulate reviews or offers, submit fraudulent claims or chargebacks, or use the site in violation of law. We may take reasonable technical and legal steps to prevent abuse.

11. Disclaimers and limitation of liability

We aim to keep product information and the website accurate and available, but the site may occasionally contain errors or be interrupted for maintenance, security, technical, or network reasons. To the extent permitted by law, the website is provided on an “as available” basis without warranties beyond those expressly stated or required by law.

To the maximum extent permitted by applicable law, 9XO will not be liable for indirect, incidental, special, punitive, or consequential loss, including loss of profit, opportunity, data, goodwill, or anticipated savings, arising from use of the website or an order. Our aggregate liability for a claim relating to a product or order will not exceed the amount you paid for the product giving rise to that claim.

These limits do not apply where liability cannot be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence, or mandatory consumer rights.

12. Indemnity

To the extent permitted by law, you agree to indemnify 9XO and its personnel and service providers against third-party claims, losses, and reasonable costs arising from content you upload, your infringement of another person’s rights, unlawful use of the website, fraud, or a material breach of these Terms. This does not require you to indemnify us for our own negligence or unlawful conduct.

13. Governing law and disputes

These Terms are governed by the laws of India. Before starting formal proceedings, please contact us through the Help Center so we can try to resolve the issue. Subject to any mandatory consumer forum or statutory jurisdiction available to you, disputes will be subject to the jurisdiction of the competent courts where 9XO’s principal place of business in India is located.

14. Changes to these terms

We may update these Terms to reflect changes to our services, policies, providers, or law. The revised Terms will be posted here with an updated date. Changes apply prospectively from publication and do not alter an already accepted order unless required by law or agreed with you.

If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver of that right.
